Agreement to Terms

By accessing or using the Diabec website (dia-bec.com), placing an order, or otherwise engaging with our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our website or services.

These Terms constitute a legally binding agreement between you and NIBARTECH LTD. We reserve the right to update these Terms at any time, and your continued use of the website after any changes constitutes acceptance of the revised Terms.

Please read these Terms carefully before making a purchase.

About Us

Diabec is a brand owned and operated by NIBARTECH LTD, a company registered in England & Wales. We specialise in natural food supplements formulated with traditional herbal ingredients.

Section 3

Products

Diabec is classified as a food supplement, not a medicine. Our products are formulated with natural herbal ingredients and manufactured in GMP-certified facilities.

Important: Diabec is a food supplement. It is not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration (FDA) or the Medicines and Healthcare products Regulatory Agency (MHRA).

  • Product descriptions, images, and ingredient information on our website are provided for informational purposes and are as accurate as possible
  • We reserve the right to modify product formulations, packaging, or descriptions at any time without prior notice
  • Colours and appearance of products may vary slightly from images displayed on the website
  • All products are intended for adult use only

Ordering & Payment

When you place an order through our website, you are making an offer to purchase our products subject to these Terms.

  • Prices - all prices displayed on our website are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without notice, but changes will not affect orders already confirmed.
  • Currency - prices are displayed in the currency applicable to your region. Currency conversion rates are determined by your payment provider.
  • Payment methods - we accept major credit and debit cards, and other payment methods available through Shopify Payments. All payments are processed securely.
  • Order confirmation - after placing an order, you will receive an email confirmation. This confirmation constitutes our acceptance of your order and forms a binding contract.
  • Order cancellation - we reserve the right to cancel any order if we suspect fraud, if the product is unavailable, or if there is a pricing error. You will be notified and fully refunded in such cases.

Shipping & Delivery

All Diabec orders include free shipping to the UK, US, Canada, Australia, and Singapore. For full details on shipping methods and delivery timeframes, please refer to our Shipping Policy.

  • We ship to the UK, US, Canada, Australia, Singapore, and select international destinations
  • Delivery timeframes are estimates and not guaranteed
  • Risk of loss and title for products pass to you upon delivery to the carrier
  • International customers are responsible for any customs duties, import taxes, or fees imposed by their local authorities

Returns & Refunds

We offer a 30-Day Refund Promise from the date of delivery. If you are not satisfied with your purchase, contact our support team to arrange a return. For full details, please refer to our Refund Policy.

Multi-Pack Orders

If you purchased a multi-pack (3 or 5 bottles) and are not satisfied after trying the first bottle:

  • We will issue a full refund for 1 bottle (the one you tried)
  • You must return all remaining unopened bottles to us at your expense
  • Refund requests for multi-pack orders are only available on your first order with Diabec
  • We cannot issue a full refund for a multi-pack if all bottles have been opened or consumed

Non-Delivery

If your order does not arrive, contact us at support@dia-bec.com. We will investigate and, in most cases, issue a full refund or reship the order at no extra cost.

Section 6A

Your Statutory Right to Cancel (EU & UK Consumers)

If you are a consumer in the European Union or the United Kingdom, you have a statutory right to cancel your order within 14 days of receiving the goods, without giving any reason. This right exists under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (UK) and the EU Consumer Rights Directive 2011/83/EU.

This statutory right is in addition to our 30-Day Refund Promise, which applies to all customers in the UK, US, Canada, Australia, and Singapore.

How to Exercise Your Right

  • Notify us of your decision to cancel within 14 days of receiving your order by sending a clear statement to support@dia-bec.com, calling us, or using the Model Cancellation Form below
  • Return the goods to us within 14 days of notifying us. You are responsible for the cost of return shipping unless the goods are faulty or incorrect
  • We will reimburse all payments received from you, including the original delivery cost (if any), within 14 days of receiving the returned goods or proof of return postage, whichever is earlier
  • Refunds will be issued to the same payment method used for the original purchase

You may open the product to inspect it (as you would in a shop), but if the product has been used beyond what is necessary to establish its nature and characteristics, we may reduce the refund to reflect any diminished value.

Section 6B

Subscriptions & Auto-Renewal

Diabec offers a "Subscribe & Save" option that provides an additional 10% discount and free shipping on recurring deliveries.

  • Billing frequency: your chosen pack is delivered and charged monthly (every 30 days) at the subscription price displayed at the time of purchase
  • Automatic renewal: your subscription will automatically renew each month until you cancel. You will be charged on each renewal date using the payment method on file
  • Price changes: if we change subscription pricing, you will be notified by email at least 14 days before the new price takes effect. Your next renewal after the notice period will be at the new price unless you cancel
  • How to cancel, pause, or modify: you can cancel, pause, or change your subscription at any time, with no penalties, by:
  • Cancellation timing: cancellations take effect before your next billing date. You will not be charged after cancellation, and you will continue to receive any shipment already processed
  • Confirmation: after subscribing, you will receive a confirmation email with your subscription details, renewal date, price, and instructions for cancelling

Diabec is a food supplement. It is not a medicine and should not be used as a substitute for medical advice, diagnosis, or treatment. Always consult your healthcare provider before starting any new supplement.

  • Not a substitute for medical advice - our products and website content are not intended to replace professional medical advice, diagnosis, or treatment
  • Individual results may vary - the effects of food supplements can differ from person to person. We make no guarantees regarding specific health outcomes.
  • Medication interactions - if you are taking prescription medications, particularly for blood sugar management, consult your doctor before use
  • Allergies - review the full ingredient list before use. Discontinue use and consult a healthcare provider if you experience any adverse reactions.

All content on the Diabec website, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of NIBARTECH LTD and is protected by intellectual property laws.

  • The Diabec name, logo, and all related branding are trademarks of NIBARTECH LTD
  • You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent
  • You may print or download content for your personal, non-commercial use only
  • Any unauthorised use of our intellectual property may result in legal action

When using our website, you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorised access to any part of the website, other accounts, or computer systems
  • Interfere with or disrupt the website's functionality, servers, or networks
  • Transmit any viruses, malware, or other harmful code
  • Use automated tools (bots, scrapers, etc.) to access or collect data from the website without our permission
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Submit false or misleading information, including fraudulent orders
  • Use the website to harass, abuse, or harm others

We reserve the right to terminate your access to our website if you violate any of these terms.

Limitation of Liability

To the fullest extent permitted by law:

  • NIBARTECH LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products
  • Our total liability for any claim arising from your purchase shall not exceed the amount you paid for the product in question
  • We are not liable for any delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, or government actions
  • We do not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England & Wales, without regard to conflict of law principles.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England & Wales, unless otherwise required by mandatory consumer protection laws in your country of residence.

Section 12

Dispute Resolution

We are committed to resolving any disputes fairly and efficiently. If you have a complaint or concern:

  • Step 1: Contact our customer support team at support@dia-bec.com. We aim to resolve most issues within 5 business days.
  • Step 2: If we are unable to resolve your complaint to your satisfaction, you may escalate the matter through an alternative dispute resolution (ADR) provider.
  • Step 3: If ADR does not resolve the dispute, either party may pursue the matter through the courts of England & Wales.

EU and UK residents may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. When changes are made:

  • The "Last updated" date at the top of this page will be revised
  • Material changes will be communicated via email or a prominent notice on our website
  • Your continued use of the website after changes are posted constitutes acceptance of the new Terms

We encourage you to review these Terms periodically. If you do not agree with any changes, you should discontinue use of our website.
