Agreement to Terms


By accessing or using the Diabec website (dia-bec.com), placing an order, or otherwise engaging with our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our website or services.

These Terms constitute a legally binding agreement between you and NIBARTECH LTD. By using this site or placing an order, you confirm that you are at least 18 years old.

Changes to these Terms: we may update these Terms. Material changes will be notified to active customers and subscribers by email at least 14 days before they take effect, and a banner will appear on the site for the same period. You may cancel any active subscription before the new Terms take effect if you do not agree with them. Non-material changes (typos, clarifications) may be made without prior notice but the "Last updated" date below will always reflect the latest revision.

Ordering & Payment


When you place an order through our website, you are making an offer to purchase our products subject to these Terms.

  • Prices - all prices displayed on our website are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without notice, but changes will not affect orders we have already accepted (see Order acceptance below).
  • Currency - prices are displayed in the currency applicable to your region. Currency conversion rates are determined by your payment provider; we do not add an FX surcharge, but your card issuer may apply its own conversion or foreign-transaction fee.
  • Payment methods - we accept major credit and debit cards, and other payment methods available through Shopify Payments. All payments are processed securely.
  • Order acknowledgement vs. acceptance - after placing an order, you will receive an email acknowledgement. This is not our acceptance of your order. A binding contract is formed only when we dispatch the goods to you, evidenced by a shipping notification email.
  • Order cancellation by us - until dispatch, we may decline or cancel any order for reasons including (but not limited to) suspected fraud, stock unavailability, an obvious pricing error, or shipping restrictions in your country. You will be notified and fully refunded for any sum already charged in such cases.

Shipping & Delivery


All Diabec orders include free shipping to the UK, US, Canada, Australia, and Singapore. For full details on shipping methods and delivery timeframes, please refer to our Shipping Policy.

  • We ship to the UK, US, Canada, Australia, Singapore, and select international destinations
  • Delivery timeframes are estimates and not guaranteed
  • Risk of loss and title for products pass to you upon delivery to the carrier
  • International customers are responsible for any customs duties, import taxes, or fees imposed by their local authorities

Returns & Refunds


We offer a 30-Day Refund Promise from the date of delivery. If you are not satisfied with your purchase, contact our support team to arrange a return.

In the event of any inconsistency between this section and the Refund Policy, the Refund Policy prevails.

Your Statutory Right to Cancel (EU & UK Consumers)


If you are a consumer in the European Union or the United Kingdom, you have a statutory right to cancel your order within 14 days of receiving the goods, without giving any reason. This right exists under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (UK) and the EU Consumer Rights Directive 2011/83/EU (as amended by the Modernisation Directive (EU) 2019/2161).

This statutory right is in addition to our 30-Day Refund Promise, which applies to all customers in the UK, US, Canada, Australia, and Singapore.

How to Exercise Your Right

  • Notify us of your decision to cancel within 14 days of receiving your order by sending a clear statement to support@dia-bec.com, calling us, or using the Model Cancellation Form below
  • Return the goods to us within 14 days of notifying us. You are responsible for the cost of return shipping unless the goods are faulty or incorrect
  • We will reimburse all payments received from you, including the original delivery cost (if any), within 14 days of receiving the returned goods or proof of return postage, whichever is earlier
  • Refunds will be issued to the same payment method used for the original purchase

You may open the product to inspect it (as you would in a shop), but if the product has been used beyond what is necessary to establish its nature and characteristics, we may reduce the refund to reflect any diminished value.

Subscriptions & Auto-Renewal


Diabec offers a "Subscribe & Save" option that provides an additional 10% discount and free shipping on recurring deliveries.

  • Billing frequency: your chosen pack is delivered and charged monthly (every 30 days) at the subscription price displayed at the time of purchase
  • Automatic renewal: your subscription will automatically renew each month until you cancel. You will be charged on each renewal date using the payment method on file
  • Price changes: if we change subscription pricing, you will be notified by email at least 14 days before the new price takes effect. Your next renewal after the notice period will be at the new price unless you cancel
  • How to cancel, pause, or modify: you can cancel, pause, or change your subscription at any time, with no penalties, by:
  • Cancellation timing: to stop a renewal, please cancel at least 24 hours before your next billing date. Cancellations received after a renewal has already been charged take effect from the following billing cycle; any shipment already dispatched from a valid renewal will be delivered and is not eligible for refund on a "I forgot to cancel" basis (defective-product and non-delivery cases remain covered by our refund policy).
  • Cancellation confirmation: once your cancellation request is received and processed by our team, we will reply by email confirming the cancellation date and that no further charges will be made. If you do not receive a confirmation within 48 hours, please reply to your original order email so we can confirm manually.
  • Subscription confirmation: after subscribing, you will receive a confirmation email with your subscription details, renewal date, price, and the cancellation instructions above.
  • Pre-renewal reminder (DMCC Act 2024, Schedule 21): at least 3 days and no more than 7 days before each subscription renewal, we will email you a reminder showing: (a) the renewal date, (b) the amount that will be charged, (c) the goods you will receive, and (d) a one-click link to cancel, pause or modify the subscription before the renewal is processed. Reminders are sent automatically; you do not need to opt in.
  • Pre-contract subscription summary: before you complete your first subscription order, the checkout displays a clear summary box stating the minimum contract length (none - cancel anytime), the renewal frequency (every 30 days), the renewal price, the total annual cost at the current price, and the cancellation method described above. This summary is provided in accordance with the DMCC Act 2024, Schedule 22 (pre-contract information for subscription contracts).

The Schedules 21 and 22 subscription-contract provisions of the Digital Markets, Competition and Consumers Act 2024 are expected to commence by Order; Diabec implements these obligations voluntarily from launch, ahead of the statutory commencement date.

User-Submitted Content

If you submit reviews, testimonials, photographs, or other content to us (whether on our website, by email, on a survey, or on a third-party review platform we use such as Trustpilot), you grant Diabec a non-exclusive, royalty-free, worldwide, perpetual and sub-licensable licence to use, reproduce, edit, translate, and display that content for product information, marketing, and customer support. We will attribute content to your display name or first name + initial only and will never publish your email address, phone number, or full address. You may ask us to remove your content at any time by emailing support@dia-bec.com; we will action removal requests within 30 days from any channel we control.

User Conduct


When using our website, you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorised access to any part of the website, other accounts, or computer systems
  • Interfere with or disrupt the website's functionality, servers, or networks
  • Transmit any viruses, malware, or other harmful code
  • Use automated tools (bots, scrapers, etc.) to access or collect data from the website without our permission

Limitation of Liability


To the fullest extent permitted by law:

  • NIBARTECH LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products
  • Subject to the carve-outs below, our total liability for any claim arising from your purchase shall not exceed the amount you paid for the product in question
  • We are not liable for any delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, or government actions
  • We do not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components

Carve-outs β€” when the cap does not apply. Nothing in these Terms excludes or limits our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • defective products under the UK Consumer Protection Act 1987, the EU Product Liability Directive 85/374/EEC (and as recast by Directive (EU) 2024/2853 once it enters into force in each Member State), or equivalent foreign legislation;
  • breach of the statutory implied terms of satisfactory quality, fitness for purpose, and description under the UK Consumer Rights Act 2015 (sections 9-11), the Australian Consumer Law (Schedule 2 to the CCA 2010), the Singapore CPFTA, the New Zealand Consumer Guarantees Act 1993, or equivalent foreign consumer-protection legislation;
  • any other liability that cannot be excluded or limited by applicable law.

Governing Law


These Terms shall be governed by and construed in accordance with the laws of England & Wales, without regard to conflict of law principles.

Consumer jurisdiction rights. If you are a consumer, you can always bring proceedings in the courts of the country where you are habitually resident, as required by Brussels I bis Regulation (Recast) (EU) 1215/2012 Articles 17-19, the UK retained version of that Regulation, and equivalent rules in Australia, Singapore, the United States, Canada and New Zealand. We will only bring proceedings against a consumer in the courts of that consumer's country of habitual residence.

For business customers (B2B), the courts of England & Wales have exclusive jurisdiction over any disputes arising under these Terms.

Dispute Resolution


We are committed to resolving any disputes fairly and efficiently. If you have a complaint or concern:

  • Step 1: Contact our customer support team at support@dia-bec.com. We aim to resolve most issues within 5 business days.
  • Step 2: If we are unable to resolve your complaint to your satisfaction, you may escalate the matter through an alternative dispute resolution (ADR) provider.
  • Step 3: If ADR does not resolve the dispute, either party may pursue the matter through the courts of England & Wales.

Alternative dispute resolution & consumer authorities. The European Commission's Online Dispute Resolution (ODR) platform was decommissioned on 20 July 2025 under Regulation (EU) 2024/3228 and is no longer available. You can instead:

Changes to Terms


We reserve the right to modify these Terms of Service. When changes are made:

  • The "Last updated" and "Last reviewed" dates at the top of this page will be revised
  • Material changes (changes to the refund, subscription, IP licence, liability or governing law sections, or that materially affect your rights) require at least 14 days' advance notice β€” by email to active customers and subscribers, and by a banner on the website for visitors without an account, in line with Section 1 above
  • Non-material changes (typos, formatting, clarifications) take effect immediately on publication
  • Your continued use of the website after material changes are posted constitutes acceptance of the new Terms; you may cancel any active subscription before the new Terms take effect if you do not agree
  • A copy of the immediately preceding version is available on request from support@dia-bec.com

Which law governs my Diabec order?

The Terms of Service are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except where local consumer law grants you the right to bring proceedings in your country of habitual residence (UK Consumer Rights Act 2015, EU consumer-protection directives).

Who is the seller behind Diabec?

The seller is NIBARTECH LTD, a private limited company registered in England and Wales (Companies House number 15283998). All sales contracts on dia-bec.com are between you and NIBARTECH LTD. The Companies House register entry is publicly searchable at find-and-update.company-information.service.gov.uk.

When does a sales contract form when I buy Diabec?

A contract forms only when we send you an order-confirmation email after successful payment authorisation. Adding an item to cart, completing checkout, or receiving the automated order-receipt email do not in themselves form a binding contract. We reserve the right to reject any order before confirmation, including in cases of pricing error or stock shortage.

What can I do if there is a pricing or description error?

If we discover a manifest error in price or description before dispatch, we will contact you, explain the correct details, and offer either a refund or the chance to proceed at the corrected price. You are under no obligation to accept the corrected price and may cancel for a full refund.

How is my subscription renewal handled?

Subscribe and Save orders renew automatically each month at the displayed subscription price (currently 10% lower than one-time purchase) with free shipping included. You can cancel, pause, or modify the schedule at any time from your account page or by emailing support@dia-bec.com. No cancellation fees apply.

Does Diabec offer a satisfaction guarantee?

Yes. First-time orders are covered by a 30-Day Refund Promise on top of your statutory rights. UK and EU consumers also retain a separate 14-day statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
